This document sets out the Terms and Conditions provided by marKey. home (ABN 47 473 138 796) for the Products.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

1. Definitions:

  • “Failure” means a sudden and unforeseen breakdown of the Product arising from a mechanical or electrical fault. However, they do not include breakdowns caused by fair wear and tear, and those faults listed in the "What’s excluded" clause of these Terms and Conditions.
  • “Manufacturer” means the manufacturer of the Product. To be clear, marKey. home is an importer and reseller of the Product, not the manufacturer.
  • “Manufacturer’s Warranty” means the voluntary warranty for parts and/or labour provided by the manufacturer of the Product.
  • “Original Purchase Price” means the amount paid by you to marKey. home to purchase the Product, as recorded on the original purchase receipt or tax invoice for your Product (less any discounts, cashback offer paid, and any other applicable reductions to the price if not shown on the receipt or tax invoice).
  • “Product” means the bidet imported into Australia and sold in Australia by us to you.
  • “Terms and Conditions” mean these terms and conditions governing this agreement.

2. What’s excluded?

This agreement does not cover any of the following:

  • A fault brought to your attention before you purchased the Product;
  • Faults caused by:
    • Negligence, accidental or deliberate misuse, or unauthorised alterations (unless committed by marKey. home);
    • Failure to follow the manufacturer’s instructions for usage, installation, operation, cleaning, or maintenance;
    • External sources, including electrical interference, power surges, and voltage fluctuations;
    • Infestations of vermin, pests, or insects;
    • Acts of God or man-made catastrophes; or
    • Water damage, rust, or corrosion;
  • Repairs to:
    • Cosmetic aspects of the Product, such as decals, paints, and other finishes, which do not affect the functional operation of the Product; or
    • Accessories used in or with the Product unless those accessories are covered under a separate agreement;
  • Cost of replacement of any consumable items required for use with the Product, such as batteries and filters;
  • Loss, damage, or costs incurred as a result of:
    • Damage to or loss of software or data caused by the Failure of the Product;
    • Damage from batteries or other consumables, internal or external to the Product;
    • Using the Product for purposes other than for personal, domestic, or household use;
    • The consequence of not being able to use the Product following Failure of the Product;
    • Transportation, installation, or removal of the Product or any replacement Product supplied by us, except freight costs as provided in clause 3 under the heading “How to make a claim”.
  • Loss, damage, or costs incurred where no Failure is identified;
  • Any claim against you by any third party for nuisance or any breach of environmental laws and regulations;
  • Normal maintenance costs, cleaning, lubrication, or external adjustments;
  • The Product if it is recalled by the manufacturer or a government agency;
  • Any claim against you by any third party including for personal injury or damage to property; or
  • Any claim by you for personal injury or damage to property.

3. Repair and Replacement Terms

In the event of a Failure of the Product, we will, at our sole discretion:

  • Arrange for repair of the Product or the parts of the Product causing the failure; or
  • If we decide the Product or its parts are unable to be repaired or that it is uneconomical to do so, replace the Product or the parts with another Product or parts of the same or similar specification.

We will repair or replace the Product or relevant parts with the same or equivalent Product or parts. If the Manufacturer or their agents only offer a refurbished part or product swap facility, we may replace the Product with a refurbished Product of the same type rather than repairing it. For the purposes of this agreement, the replacement in this instance will be deemed a repair. Refurbished parts may be used to repair the Product at our sole discretion.

Where we have elected to replace a Product, and a Product with equivalent specifications as determined by us is unavailable, we may elect to refund you up to the value of the Original Purchase Price. No replacement Product or refund will exceed the Original Purchase Price of your Product. The replacement Product we supply may have a lower selling price and is not limited to the Manufacturer of the original Product.

Where we have replaced the Product, the faulty Product or parts replaced become our property.

4. False or exaggerated claims

We may refuse to action a claim under this agreement or reduce the benefits available to you in respect of the claim if, in our reasonable opinion, you make any misrepresentation or commit any fraudulent or dishonest act or omission in connection with the claim.

5. Not a performance guarantee or insurance

This agreement is not a guarantee of performance or an insurance policy, nor is marKey. home an insurer.

6. How to make a claim

To make a claim under this agreement, please:

  • Contact us by emailing inquiries@markeyhub.com detailing the Failure;
  • Once you receive an acknowledgement from us, arrange for transport of the Product or faulty part to us (unless we inform you otherwise).

We will reimburse you the cost to courier or freight the Product from your nominated location to us, but we will not be obliged to do so if we reasonably determine that the claim is excluded under clause 2 or is false or exaggerated under clause 4 of these Terms and Conditions.

7. Transfer

This agreement is for your benefit only.

No benefits will be given to anyone else unless we agree to transfer this agreement to another person due to your request. You can transfer this agreement to a new owner of the Product at no cost to you. To organize the transfer, please email us at inquiries@markeyhub.com.

This agreement shall not be taken to be transferred to another person until and unless we have confirmed the transfer in writing.

8. Cancellation of this agreement

You may cancel this agreement at any time by emailing us your cancellation request to inquiries@markeyhub.com.

We have the right to cancel this agreement if you commit a material breach of these Terms and Conditions, you have given any false information to us when submitting a claim or otherwise, or for any other reason allowable by law. We will provide you with written notice of the cancellation.

9. Law and Jurisdiction

This agreement is governed by the laws of the State of Victoria. You and we agree to submit to the exclusive jurisdiction of the courts and tribunals of Victoria in relation to any dispute arising from this agreement.

What is a bidet ?

A bidet (pronounced “bih-DAY”) is a plumbing fixture designed to clean your rear. A bidet attachment is a modern bidet that connects to your existing toilet. It goes to work washing your lower region after you P or Poop, eliminating the need for toilet paper.

Some bidets attach to your toilet, either affixed to the side of the bowl or with a detachable hose. Other bidets are standalone fixtures that resemble a low sink.

How do I install my marKey bidet ?

Disclaimer:
marKey. Bidets must be installed by a licensed plumber. This ensures installation complies with Australian standards and water supply connections are installed to avoid cross-contamination. We cannot provide plumbing advice for your specific situation.

Here are the basics are:

  • Shut off your water supply and flush your toilet.
  • Remove your toilet seat and do a deep clean.
  • Attach the bidet to your water supply and toilet using the connections supplied.
  • If you have a bidet attachment, reinstall your toilet seat.

Where does the bidet get water from ?

Bidets use the same clean water you brush your teeth with to wash your butt. Attachments and electric seats connect to your existing toilet/plumbing, while stand-alone bidets are installed beside your toilet. With the turn of a knob or press of a button, a fresh stream of water sprays your b-hole at the perfect angle. Instead of smearing or shedding TP, bidets wash away bacteria after you poop.

Are Bidets sanitary ?

Bidets can arguably be considered more sanitary than traditional bottom-cleaning methods.

Does marKey ship internationally ?

We currently ship only to the U.S., Canada, and Australia. There is an additional shipping fee to send your marKey bidet outside of the Australia. Simply add your shipping address at checkout and it will calculate your shipping charge automatically. You may be charged additional import fees that marKey is not responsible for.

What is marKey return policy ?

What is the return condition ?

1. You have 30 days to decide if an item is right for you, if you would like to return the item please contact us within 30 days of delivery.
2. Returned items must be in their unused condition with the original packing. We do not accept a returned item that has been worn, damaged, washed, or altered in any way.
4. Items with non-returnable marks and free gifts cannot be returned.
5. We do not accept returned items that have been sent back without proper returns requests.
6. We do not offer Freight To Collect (FTC) service for the packages returned to us.
7. Please be sure to double-check your returns before shipping them out. We are not responsible for the return of non-Samodra products .
Note: If the return is caused by the consumer, the consumer should be responsible for the shipping costs. The specific fee should be based on the express company you choose.If, for our reasons, the goods received are damaged or incorrect and the consumer is not obliged to bear the shipping costs.

How long does it take to ship marKey bidet ?

Does marKey offer warranty for it's bidet ?

marKey provides an 18-month limited warranty on the bidet!

A. Applicable
This limited bidet guarantee is applicable to marKey bidet purchased from any channel.

B. Who Does This Bidet Warranty Cover?
This limited bidet warranty also extends to the original purchaser of a bidet. The limited bidet guarantee does not apply to customers who bought their bidet for commercial purposes (e.g. in a hotel or shop).

All warranties, including those implied, are valid only for the period in which the bidet is owned by the original purchaser of the bidet. 

C. marKey's Limited Bidet Warranty and Responsibilities
marKey guarantees the bidet in its original packaging, which was sold to you, for material and workmanship defects ("defects") for a period of 18 months from the time your bidet is delivered to you, if the bidet is normal for the intended purpose Purpose is used purposes in the home.

D. What This Limited Bidet Warranty Covers
This limited bidet warranty applies to defects due to faulty workmanship or materials, subject to the limitations described in this warranty.

This Limited Bidet Warranty does not apply to the following:

- Normal wear and tear.
- Comfort preference.
- Physical abuse or damage to the structure and / or covering material including, but not limited to, burns, cuts, tears, fluid damage or stains; provided that the defect is caused by such abuse or damage.
- Damage caused by commercial use, e.g. B. in a hotel or shop.
- Any bidet (whether or not manufactured by marKey) sold by resellers who are not authorized retailers.
- In the event of a defect, marKey's sole and exclusive liability and your only remedy under this Limited Bidet Warranty will be to provide a replaced bidet at marKey's option, provided that you meet “Your Responsibilities” below.

E. Your responsibility
In the event of a defect and to benefit from this limited bidet guarantee, you must provide marKey with proof of the original purchase date.Proof of a defect and any claims must be sent to the email address inquiries@markey.com. marKey will replace (if applicable) and send your bidet back to you.

Replaced bidets are covered by the same limited bidet warranty as the original bidet. If you receive a replaced bidet, the warranty period of the replaced bidet starts from the date of purchase of the original bidet.
